*SAMPLE* Great Pyrenees Dog Sales Agreement
This is a legal contract entered into on this date _____________ by ______________________________________, hereinafter referred to as SELLER, and _____________________________________, hereinafter referred to as BUYER of a Great Pyrenees DOG, hereinafter referred to as DOG born on October 16, 2014.
BUYER and SELLER agree to abide by the terms as stated in this agreement. This transaction is under the following warranties and/or conditions and no other warranties or conditions are expressed or implied.
1a. BUYER agrees to obtain from SELLER a DOG for the purchase price of $_______. BUYER has paid a deposit of $_______ on ______________. BUYER agrees to pay the remaining balance of $_______ in cash, money order, or by online payment via our website prior to receiving the DOG or prior to shipping the DOG.
1b. The deposit is refundable if SELLER does not have a dog available for purchase. If SELLER has a dog available that fits BUYER’S needs and BUYER chooses not to purchase a dog, the deposit will not be refunded. The paid deposit shall go toward the purchase price of the DOG. Date deposit received determines placement order.
1c. SELLER reserves the right to refuse to sell a puppy to anyone for any reason.
2. PURPOSE OF THE DOG:
2a. BUYER understands these Great Pyrenees dogs are raised and bred as a livestock guardian, or farm guard dog, or family guardian with the temperament and disposition to match and is purchasing the DOG for this capacity.
3a. BUYER agrees to take possession of the DOG no earlier than December 25, 2014 (ten weeks old) and no later than January 8, 2015 (twelve weeks old), unless otherwise mutually agreed upon in writing. BUYER agrees to pick-up the DOG at SELLER’s location, unless otherwise mutually agreed upon in writing. Failure of BUYER to pay the remaining balance and/or pick up the DOG by January 8th, 2015 without a written mutual agreement stating otherwise, will result in the termination of this contract, releasing SELLER from all obligations to BUYER; the forfeiture of BUYER’S deposit to SELLER; all rights to the DOG will return to SELLER; and SELLER may offer the DOG for sale to another buyer.
4. WELL PUPPY GUARANTEE:
4a. SELLER guarantees the DOG to be healthy and free of disease upon receipt of BUYER.
4b. BUYER agrees to have the DOG examined by a licensed veterinarian within three (3) business days from date of possession. If within these three business days the veterinarian finds that the DOG is in ill health SELLER must be notified immediately and BUYER may return the DOG, at BUYER’S expense, with a signed statement from the veterinarian explaining the illness found within seven days from date of possession to ro receive a full refund of the purchase price. SELLER reserves the right to have the DOG reexamined by a veterinarian of our choice at our expense. If the above conditions are not met within the specified times, no refund will be issued. The DOG must be returned to receive a refund. If BUYER decides to retain possession of the DOG, no refund will be issued and BUYER shall thereafter hold SELLER blameless and not liable for any existing or future medical condition of the DOG, unless otherwise covered under section five (5) of this contract. SELLER does not accept responsibility for any harm that comes to the DOG once in BUYER’S possession such as accidents, electrocution, heat related conditions or any other related actions. SELLER does not accept responsibility for contagious disease diagnosed three (3) days after date of possession.
4c. The value for the purpose of this guarantee is solely the original purchase price of the DOG. This guarantee does not cover veterinary expenses or return shipping costs. All expenses incurred in relation to this DOG after BUYER has taken possession are the sole responsibility of BUYER and will under no circumstances be reimbursed.
5. THREE YEAR HEALTH GUARANTEE:
5a. SELLER guarantees the DOG to be free of inherited genetic defects or inherited diseases which are life-threatening or would severely impact the quality of the life of the DOG for a period of three (3) years from the DOG’S date of birth.
5b. BUYER is required to send SELLER a notarized veterinarian report with finding stated, to a medical certainly, that the condition or death was in fact caused from a prenatal state and not caused by or exacerbated by factors related to the care of the DOG by BUYER, including but not limited to the DOG being overweight, being fed high growth puppy food before the age of two, receiving inadequate nutrition, being spayed or neutered before the age of two (2). BUYER is required to send the notarized veterinarian report by registered mail along with the DOG’S medical records, including proof the DOG has been spayed or neutered, to SELLER. SELLER’S veterinarian must confirm and agree with the diagnosis. If the above requirements are met within the stated time period, SELLER will give BUYER a full refund of the original purchase price of the DOG. The DOG may be returned to SELLER at the expense of BUYER, if BUYER so chooses. If the above requirements are not met within the specified times, no refund will be issued.
5c. The value for the purpose of this guarantee is solely the original purchase price of the DOG. This guarantee does not cover veterinary expenses or return shipping costs. All expenses incurred in relation to this DOG after BUYER has taken possession are the sole responsibility of BUYER and will under no circumstances be reimbursed. This warranty applies to the original BUYER and is not transferable.
6. PROPER CARE:
6a. BUYER shall take proper precautions for care and safety of the DOG. Care shall include but is not limited to proper nutrition and shelter, maintenance and needed medical care. All guarantees are invalid if DOG’S illness or death is the result of neglect, exposure to weather, injury, choking or poisoning.
7a. If BUYER can no longer keep the DOG for any reason, SELLER must be notified and BUYER must return the DOG to SELLER. The purchase price and deposit will not be refunded with the exception of Section #4 or Section #5 described above. BUYER agrees to pay all costs of returning the DOG to SELLER. At no time is the DOG to be given away, placed in a shelter, or euthanized without SELLER's knowledge and permission with the exception of euthanization due to a serious illness as determined by a licensed veterinarian.
7b. If BUYER ever puts the DOG up for sale, SELLER retains the right of first refusal to buy the DOG from BUYER.
8. CUSTOMER SUPPORT
8a. SELLER agrees to be and to remain available to BUYER, and/or BUYER'S Agent whenever advice, assistance or information is needed in any matter having to do with the animal's welfare.
9a. Any disputes will be litigated in PIckens County, Jasper, Georgia, USA.
10a. Any breach of this contract will void and nullify the terms and conditions of this contract.
This is the entire agreement ( ___ pages) between the parties and is a valid and agreed to by all parties. All parties have read and understood and agreed to this contract in full by signing below. If parties choose to use electronic signatures they understand that this is still a valid agreement.
